These Terms and Conditions ("Terms") govern your use of our website at https://www.apexwindowstx.com (the "Site"), the interactive tools we make available on the Site, including our online window visualization tool, and the services we provide, including foggy glass replacement, double-pane window repair, and related window services (collectively, the "Services"). By accessing or using the Site, the tools, or the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site, the tools, or the Services.

2. Services
Apex Windows TX provides foggy glass replacement, double-pane window repair, insulated glass unit (IGU) replacement, whole home window replacement, shower glass replacement, mirror replacement, commercial storefront installation and replacement, along with other related residential and commercial window services across the Dallas-Fort Worth metroplex. Our service area covers 55 cities including Dallas, Fort Worth, Plano, Frisco, McKinney, Richardson, Carrollton, Arlington, Irving, Southlake, Garland, Keller, Denton and surrounding communities.
All services are subject to availability, scheduling, and on-site assessment. We reserve the right to decline any project at our sole discretion.
3. Estimates and Pricing
We provide free, no-obligation estimates for our services. Estimates are based on information provided by the customer and visual inspection of the property. Final pricing may vary from the initial estimate if:
- The scope of work changes after on-site assessment
- Additional damage or issues are discovered during the project
- Custom or specialty glass is required beyond standard specifications
- Access conditions differ from what was initially described
Any changes to pricing will be communicated to and approved by the customer before work proceeds. We will never perform additional work without your prior authorization.
4. Scheduling and Appointments
Appointments are scheduled on a first-come, first-served basis. While we make every effort to honor scheduled appointments, unforeseen circumstances (weather, supply delays, emergencies) may occasionally require rescheduling. We will notify you as soon as possible if any changes are needed.
If you need to cancel or reschedule an appointment, please provide at least 24 hours’ notice by calling (214) 263-3008 or emailing sales@apexwindowstx.com.
5. SMS Communications
By providing your phone number through our website form or verbally to our team, you consent to receive SMS text messages from Apex Windows TX related to your service request, including confirmations, appointment reminders, estimates, window visualization previews you request, and follow-up communications.

- SMS consent is not required to purchase our services.
6. Payment Terms
Payment is due upon completion of services unless otherwise agreed in writing. We accept the following payment methods:

- Zelle
- Affirm
The list includes primary payment methods, but others may also exist as they become available or unavailable.
On all projects, a deposit will be required before work begins. Deposit requirements will be clearly communicated during the estimate process. All deposits are non-refundable once materials have been ordered.
7. Warranty
Apex Windows TX stands behind the quality of our work. Our warranty coverage includes:
- 10-Year Seal Warranty — covers failure of the insulated glass unit seal resulting in fogging or moisture between panes
- Lifetime Craftsmanship Warranty — covers defects in workmanship and installation for as long as you own the property
- Manufacturer Warranty – Apex will work to coordinate with the manufacturer and homeowner/customer to complete any warranty claims
Warranty claims must be reported to us in writing (email or mail) within 30 days of discovering the issue. Warranty does not cover:
- Damage caused by accidents, misuse, neglect, or acts of nature (storms, hail, flooding)
- Normal wear and tear, including minor cosmetic imperfections that do not affect performance
- Damage resulting from modifications or repairs performed by anyone other than Apex Windows TX
- Glass breakage from impact or external force
- Issues arising from structural defects in the building or window frame not installed by us

8. Customer Responsibilities
To ensure efficient and safe service delivery, customers agree to:
- Provide accurate information about the property and the windows requiring service
- Ensure clear and safe access to all windows included in the project
- Remove or relocate fragile items, furniture, or obstructions near work areas prior to our arrival
- Secure pets during service appointments
- Ensure an authorized adult (18+) is present during the service appointment
- Disclose any known hazards (e.g., lead paint, asbestos, structural concerns) prior to service
9. Window Visualization Tool
9.1 About the Tool
Our Site offers an online window visualization tool that allows you to upload a photograph of a property and receive a computer-generated illustration showing how that property might look with different window frame colors and grid styles. The tool is provided free of charge, for design inspiration and to help you request an estimate. Your use of the tool is subject to these Terms.
9.2 Photographs You Upload
By uploading a photograph, you represent and warrant that you own the photograph or have permission to submit it, and that you own the depicted property or have the owner’s permission to request a visualization of it.
You grant Apex Windows TX a non-exclusive, royalty-free license to store, reproduce, and modify the photograph — including by processing it through third-party artificial intelligence services — for the purpose of generating and delivering the visualization you requested and providing you with an estimate. You retain ownership of your photograph.
We will not use your photograph in advertising or marketing materials without your separate, express permission.
You may not upload photographs containing identifiable individuals, or any content that is unlawful, infringing, or that you do not have the right to submit.
9.3 Visualizations Are Conceptual
Window visualizations are computer-generated conceptual illustrations produced by artificial intelligence from the photograph you provide. They are provided for design inspiration only. They are not photographs of completed work, not an estimate or quote, and not a representation of the products, colors, finishes, or results Apex Windows TX will supply.
Actual appearance will vary based on product selection, glass type, available finishes, existing window openings, site conditions, and installation. Colors shown are approximations and will differ depending on your screen, lighting, and manufacturing variation. A frame color you request may not be available; availability will be confirmed by Apex Windows TX.
9.4 Third-Party Processing and Model Improvement
To generate visualizations we use third-party artificial intelligence image-processing services. Your photograph is transmitted to those services in order to produce your visualization.
Your photograph, the visualization generated from it, and related technical information may also be used to develop, evaluate, and improve artificial intelligence models and the quality of our visualization tool. This includes models operated by Apex Windows TX and models operated by our third-party providers, and it may mean your photograph is retained by those providers and used for purposes beyond producing your individual visualization.
We remove location and device metadata from uploaded photographs before processing them.
You may decline this use. You may opt out at the time you upload your photograph, or at any time afterward by emailing sales@apexwindowstx.com. Declining does not affect your ability to receive your visualization, to obtain an estimate, or to purchase our services. If you decline, we will not submit your photograph for model development or training, and we will instruct our providers not to retain it for those purposes.
We do not sell your photographs.
9.5 Retention and Deletion
We retain uploaded photographs and generated visualizations for the length of your available warranty in order to support your estimate, your service history, and our warranty obligations, after which they are deleted. You may request deletion of your photograph and visualization at any time by emailing sales@apexwindowstx.com, and we will delete them within a reasonable period unless we are required to retain them by law.
9.6 Your Texas Privacy Rights
Apex Windows TX is subject to the Texas Data Privacy and Security Act. If you are a Texas resident, you have the right to confirm whether we are processing your personal data and to access that data; to correct inaccuracies in it; to obtain a copy of it in a portable format; to delete it; and to opt out of processing for targeted advertising, the sale of personal data, or profiling in furtherance of decisions that produce legal or similarly significant effects.
To exercise any of these rights, email sales@apexwindowstx.com or write to us at the address in Section 19. We may need to verify your identity before acting on your request. We will respond within forty-five (45) days, and may extend that period once by an additional forty-five (45) days where reasonably necessary, in which case we will tell you why.
If we decline to act on your request, we will tell you why and explain how to appeal. You may appeal by replying to our response or by emailing sales@apexwindowstx.com with the word "Appeal" in the subject line. We will respond to an appeal in writing within sixty (60) days. If the appeal is denied, you may submit a complaint to the Texas Attorney General at texasattorneygeneral.gov.
10. Limitation of Liability
To the fullest extent permitted by Texas law, Apex Windows TX’s total liability for any claim arising from or related to the Site, the window visualization tool, or our Services shall not exceed the total amount paid by the customer for the specific service giving rise to the claim, or one hundred dollars ($100) where no amount has been paid.
In no event shall Apex Windows TX be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, regardless of the cause of action or theory of liability.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
11. Intellectual Property
All content on this Site — including text, images, graphics, logos, videos, and design elements — is the property of Apex Windows TX or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this Site without our prior written consent.
The Apex Windows TX name, logo, and all related marks are trademarks of Apex Windows TX. Unauthorized use of any trademark displayed on this Site is strictly prohibited.
This Section does not apply to photographs you upload through the window visualization tool, which are governed by Section 9.2.
12. Website Use
By using this Site, you agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable local, state, or federal law
- Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems
- Interfere with or disrupt the Site or servers connected to the Site
- Use automated tools (bots, scrapers, crawlers) to access the Site without our written permission
- Submit false, misleading, or fraudulent information through any form on the Site
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Upload any photograph that you do not own or have permission to submit, that depicts property you do not own or have permission to photograph, or that contains identifiable individuals
We reserve the right to restrict or terminate access to the Site for any user who violates these Terms.
13. Third-Party Links
This Site may contain links to third-party websites or services that are not owned or controlled by Apex Windows TX. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. Inclusion of any link does not imply endorsement by Apex Windows TX.
This Section concerns links to third-party websites. Third-party services that process photographs you upload are addressed separately in Section 9.4.
14. Indemnification
You agree to indemnify, defend, and hold harmless Apex Windows TX, its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site or Services, your violation of these Terms, or your violation of any rights of a third party.
15. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Services shall first be attempted to be resolved through good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through binding arbitration administered under the rules of the American Arbitration Association, with arbitration taking place in Collin County, Texas.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
16. Force Majeure
Apex Windows TX shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemics, government actions, supply chain disruptions, labor disputes, or utility failures.
17. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect.
18. Changes to These Terms
We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page. Material changes will be communicated through a notice on our Site. Your continued use of the Site or Services after any changes constitutes your acceptance of the updated Terms.
