Apex Windows TX provides foggy glass replacement, double-pane window repair, insulated glass unit (IGU) replacement, and related residential and commercial window services across the Dallas-Fort Worth metroplex. Our service area covers 48+ cities including Dallas, Fort Worth, Plano, Frisco, McKinney, Arlington, Irving, Southlake, Garland, and surrounding communities.

All services are subject to availability, scheduling, and on-site assessment. We reserve the right to decline any project at our sole discretion.

3. Estimates and Pricing

We provide free, no-obligation estimates for our services. Estimates are based on information provided by the customer and visual inspection of the property. Final pricing may vary from the initial estimate if:

  • The scope of work changes after on-site assessment
  • Additional damage or issues are discovered during the project
  • Custom or specialty glass is required beyond standard specifications
  • Access conditions differ from what was initially described

Any changes to pricing will be communicated to and approved by the customer before work proceeds. We will never perform additional work without your prior authorization.

4. Scheduling and Appointments

Appointments are scheduled on a first-come, first-served basis. While we make every effort to honor scheduled appointments, unforeseen circumstances (weather, supply delays, emergencies) may occasionally require rescheduling. We will notify you as soon as possible if any changes are needed.

5. Payment Terms

Payment is due upon completion of services unless otherwise agreed in writing. We accept the following payment methods:

  • Cash
  • Check
  • Credit/debit cards (Visa, Mastercard, American Express, Discover)
  • Bank transfer (ACH/wire)
  • PayPal
  • Square

For larger projects, a deposit may be required before work begins. Deposit requirements will be clearly communicated during the estimate process. All deposits are non-refundable once materials have been ordered.

6. Warranty

Apex Windows TX stands behind the quality of our work. Our warranty coverage includes:

  • 10-Year Seal Warranty — covers failure of the insulated glass unit seal resulting in fogging or moisture between panes
  • Lifetime Craftsmanship Warranty — covers defects in workmanship and installation for as long as you own the property

Warranty claims must be reported to us in writing (email or mail) within 30 days of discovering the issue. Warranty does not cover:

  • Damage caused by accidents, misuse, neglect, or acts of nature (storms, hail, flooding)
  • Normal wear and tear, including minor cosmetic imperfections that do not affect performance
  • Damage resulting from modifications or repairs performed by anyone other than Apex Windows TX
  • Glass breakage from impact or external force
  • Issues arising from structural defects in the building or window frame not installed by us

7. Customer Responsibilities

To ensure efficient and safe service delivery, customers agree to:

  • Provide accurate information about the property and the windows requiring service
  • Ensure clear and safe access to all windows included in the project
  • Remove or relocate fragile items, furniture, or obstructions near work areas prior to our arrival
  • Secure pets during service appointments
  • Ensure an authorized adult (18+) is present during the service appointment
  • Disclose any known hazards (e.g., lead paint, asbestos, structural concerns) prior to service

8. Limitation of Liability

To the fullest extent permitted by Texas law, Apex Windows TX's total liability for any claim arising from or related to our Services shall not exceed the total amount paid by the customer for the specific service giving rise to the claim.

In no event shall Apex Windows TX be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, regardless of the cause of action or theory of liability.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

9. Intellectual Property

All content on this Site — including text, images, graphics, logos, videos, and design elements — is the property of Apex Windows TX or its licensors and is protected by copyright, trademark, and other intellectual property laws. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

14. Force Majeure

Apex Windows TX shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, severe weather, pandemics, government actions, supply chain disruptions, labor disputes, or utility failures.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such finding shall not affect the validity of the remaining provisions, which shall continue in full force and effect.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make changes, we will update the "Effective Date" at the top of this page. Material changes will be communicated through a notice on our Site. Your continued use of the Site or Services after any changes constitutes your acceptance of the updated Terms.
